Terms of Service

These Terms of Service ("Terms") govern your access to and use of Catwalk (the "App"), operated by the Catwalk service provider ("we," "us," or "our"). By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App in the United States. If you are in the European Economic Area, United Kingdom, or Switzerland, you must be at least the age of digital consent in your country (often 16, or 13–15 with parental permission). The App is not directed at children under 13.

2. Apple App Store and Apple's Licensed Application End User License Agreement (EULA)

If you obtained the App from the Apple App Store, your use is also subject to Apple's Standard Licensed Application End User License Agreement ("LATAS"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of conflict between these Terms and the LATAS as applied by Apple, the LATAS governs solely with respect to your license from Apple. Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

3. Accounts and authentication

You may sign in using Apple, email, or other methods we support via Firebase Authentication. You must provide accurate information and safeguard your credentials. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or pose risk to the service or others.

4. Subscriptions, trials, and consumable credits

Subscriptions. Paid subscriptions are billed by Apple to your Apple ID. Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period. You can manage or cancel in your Apple ID account settings. Trial conversions and renewal timing follow Apple's and RevenueCat's handling of your purchase.

Consumable credits. Credit packs are one-time, non-subscription in-app purchases. Credits are consumed when you use generation features. Unless we state otherwise in the App, credits are not automatically expiring; they are non-refundable once consumed.

Credit use; no guarantee. Generation attempts may consume credits even if the resulting output is unsatisfactory, imperfect, or fails to meet your expectations. Except where required by law (and subject to Apple's policies for App Store purchases), purchases and consumed credits are non-refundable.

Credits after cancellation. If you cancel a subscription (or it expires / enters a billing issue state), any remaining credits on your account may be removed and your credit balance may be reset to zero.

Refunds. Payment disputes and refunds for purchases through Apple are handled by Apple according to Apple's policies. We do not guarantee refunds for subscriptions or credits except as required by law.

5. User content, license grant, and representations

You retain ownership of photos and other content you upload ("User Content"). To operate the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, process, transmit to our subprocessors and AI providers, and display User Content and resulting outputs as needed to provide the service you request.

You represent and warrant that: (a) you own or have all necessary rights to User Content; (b) if the photo depicts a person, you are that person or have their written permission; (c) User Content does not depict minors in violation of law or policy, nudity or sexual content in violation of our Content Policy, or other prohibited content; and (d) your use of the App complies with law.

6. AI-generated outputs

Outputs are generated by artificial intelligence and third-party models. They are provided "as is." We do not guarantee accuracy, likeness fidelity, uniqueness, or that outputs will not resemble content generated for others. You are solely responsible for how you use outputs. You may not use outputs for illegal purposes, non-consensual intimate imagery, impersonation to deceive, harassment, or other uses prohibited in our Content Policy.

Output quality and likeness depend on many factors outside our control, including the photos you upload (e.g., image quality, lighting, angle, pose, facial visibility, background clutter, occlusions, and edits), model limitations, and service availability. Results may be imperfect, may fail to generate, and may differ from your expectations or from your original photo. We do not guarantee that any output will accurately reflect your appearance or any specific features.

7. Acceptable use and Content Policy

You must comply with our Content Policy, including prohibitions on child sexual abuse material, harassment, hate speech, malware, scraping, circumventing security (including App Check), and misuse of AI outputs. We may remove content, suspend accounts, and cooperate with law enforcement where appropriate.

8. Moderation and reporting

We provide mechanisms to report concerns. See Support for how to report content or behavior. We aim to review good-faith reports within a reasonable time (often within 24–72 hours for standard reports, subject to volume and complexity).

9. DMCA and intellectual property

We respect intellectual property rights. Our DMCA process is described at DMCA / copyright. Repeat infringers may lose access to the App.

10. Digital Services Act (EU)

If you are in the EU, you may contact us for illegal content reports and transparency requests at support@catwalk.online. We act on notices that meet applicable legal requirements.

11. Disclaimers

THE APP AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

13. Indemnity

You will defend, indemnify, and hold harmless the Catwalk operator and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of outputs, or your violation of these Terms or law.

14. Dispute resolution (United States)

If you are a consumer in the United States, you and we agree that disputes will be resolved by binding individual arbitration under the rules of a recognized arbitration provider, except that either party may seek injunctive relief in court for intellectual property or misuse of the service. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@catwalk.online with subject "Arbitration opt-out."

EU/UK consumers: Nothing in these Terms limits mandatory rights you have under the laws of your country of residence.

15. Governing law

These Terms are governed by the laws applicable to the Catwalk operator's jurisdiction, without regard to conflict-of-law rules, except where mandatory consumer laws of your country apply.

16. Export and sanctions

You may not use the App in violation of export control or sanctions laws.

17. Changes

We may update these Terms by posting a new version and updating the "Last updated" date. Material changes may require renewed acceptance in the App. Continued use after notice may constitute acceptance where permitted by law.
